Solution Except as expressly set forth herein, ATS All Tire Supply Company makes no guarantee or other warranty, express or implied, of the goods sold here under or the merchantability, fitness or suitability for particular purpose or condition, ATS Company disclaims, and customer acknowledges and agrees thereto, any and all liability on the part of ATS Company with respect thereto or arising therefrom, and except as expressly set forth herein, ATS company shall not be responsible or liable for any claim, loss, damage, liability or expense of any kind or nature, including, but not limited to special, incidental or consequential damages or loss of profits, whether actual or anticipated, caused, directly or indirectly, by the goods sold or the inadequacy thereof for any purpose, or any defect or deficiency therein, or the use or operation thereof, or the interruption or loss of the service or use thereof, or arising from any other reason or cause whatsoever relating to or concerning the goods sold hereunder, ATS Company warrant that for a period of 90 days from delivery, goods provided by ATS Company will be free from defects in material and workmanship and will conform to the specifications designated there fore, provided that they have been properly installed and maintained, Provided customer notifies ATS Company of such defect with in 90 days from delivery of the goods ATS Company at its option and expense will either repair or replace such defective goods.
